These General Terms and Conditions (T&C) apply to all orders placed via our website. This offer is exclusively directed at consumers residing in Switzerland (hereafter referred to as "customer").

A consumer is defined as a natural person who enters into business relations with The Nourished Club which cannot be attributed to either their commercial or independent professional activities. Orders in quantities that are not usual for households may be rejected without justification.

The Nourished Club reserves the right to change these T&C at any time. The version of these T&C valid at the time of the order, which cannot be unilaterally changed for this order, shall apply. Conditions of the customer that conflict with or deviate from these T&C will not be recognized. The operator of this website is Lifestyle by Renevey & Buhofer.

Prices

The sales prices listed on The Nourished Club are final prices.

Any shipping costs, where not provided otherwise, will be charged additionally and are to be paid by the customer. Shipping costs will be separately shown during the ordering process.

Technical changes, errors, and misprints are reserved, especially The Nourished Club can make price changes at any time without notice. The sales prices do not include consulting and support services.

Conclusion of Contract 

The products and prices on this website are considered as non-binding offers.

By placing an order on this website including acceptance of these T&C, the customer submits a legally binding offer to conclude a contract. The Nourished Club will then send an automatic order confirmation email, which confirms that the customer's offer has been received by The Nourished Club. Orders made by the customer are binding. Unless otherwise noted, there is no right of return or withdrawal.

The contract is concluded as soon as The Nourished Club sends an acceptance email, confirming the shipment of the ordered products or services.

Orders will only be shipped after full payment has been received (exception: delivery against invoice) and if the goods are available. If it turns out that the ordered goods cannot be delivered in full or at all, The Nourished Club is entitled to reject the order in whole or in part. In such a case, The Nourished Club will inform the customer via email. If the customer's payment has already been received by The Nourished Club, the payment will be refunded to the customer. If no payment has been made yet, the customer will be released from the obligation to pay.

Payment Options and Retention of Title

The customer has the payment options indicated during the ordering process.

The Nourished Club reserves the right, without giving reasons, to exclude customers from individual payment options or to insist on prepayment.

Delivery, Duty to Inspect, Notification of Defects, and Returns

Deliveries are sent by mail or courier service to the address specified by the customer in the order.

The Nourished Club strives to adhere to as short delivery times as possible. However, any delivery times stated in the order confirmation are non-binding. The Nourished Club is entitled to partial deliveries. In this case, shipping costs will be charged to the customer only once.

The invoice is sent by The Nourished Club by email or by post, depending on The Nourished Club's choice, provided that delivery against invoice is offered.

If the delivery is undeliverable or the customer refuses to accept the delivery, The Nourished Club may dissolve the contract after notifying the customer by email and observing a reasonable grace period, and charge the costs for the inconvenience.

The customer is obligated to inspect the delivered goods immediately upon receipt of the delivery and to notify The Nourished Club in writing by email of any defects for which The Nourished Club provides a warranty. The goods can only be returned if the supplier of the goods offers this.

Warranty

The Nourished Club strives to deliver the ordered goods in perfect quality.

The Nourished Club is unable to make assurances or guarantees regarding the timeliness, completeness, and correctness of the data as well as the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it is neither assured nor guaranteed that the use of the website will not infringe rights of third parties not owned by The Nourished Club.

Liability

The Nourished Club excludes any liability, regardless of its legal basis, as well as claims for damages against The Nourished Club and any auxiliary persons and agents. The Nourished Club, in particular, is not liable for indirect damages and consequential harm, lost profits, or any other personal, material, and pure financial losses of the customer. A further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.

The Nourished Club uses hyperlinks only for the simplified access of the customer to other web offerings. The Nourished Club cannot know the content of these web offerings in detail, nor assume liability or any other responsibility for the content of these websites.

Data Protection

The Nourished Club may process and use the data collected during the conclusion of the contract to fulfill the obligations from the purchase contract and use it for marketing purposes. The data necessary for the performance of the service can also be passed on to commissioned service partners (logistics partners) or other third parties.

Severability Clause

Should individual provisions of these T&C be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Further Provisions

The Nourished Club expressly reserves the right to change these T&C at any time and to put them into effect without notice.

In the event of disputes, exclusively substantive Swiss law shall apply, excluding the norms of conflict of laws. The UN Sales Convention (CISG, Vienna Sales Convention) is explicitly excluded.
